§ 1
GENERAL PROVISIONS
1. The Referral Program is conducted via the www.redini.app website by Dawid Ireneusz Martenczuk conducting business under the name H0PE.CLOUD DAWID MARTENCZUK entered in the Central Register and Information on Business Activity conducted by the Minister responsible for economy, VAT ID: PL7393926062, REGON: 382989590, business address and address for delivery: ul. Żurawia 64, 11-036 Naglady, e-mail address: contact@redini.app, telephone number: +48 585 008 438.
2. The Referral Program operates under the terms of these Regulations.
3. The regulations specify:
a) purpose of the Referral Program,
b) rules for participation in the Referral Program,
c) rules for obtaining Referral status,
d) The rules for recommending the Service by the Referrer and
e) rules for receiving discount coupons for referrals.
4. Each Partner is obliged to comply with the provisions of these Terms and Conditions as soon as he starts activities aimed at using the Referral Program.
5. In order for the Partner to join and participate in the Referral Program, it is necessary to become familiar with the Regulations and accept their provisions.
6. In matters not covered by these Regulations, the provisions of the Regulations of the www.redini.app website, provisions of the Civil Code and other relevant provisions of Polish law shall apply.
§ 2
DEFINITIONS
1. CODE - a unique code individually assigned to each Referrer, visible Panel.
2. ACCOUNT - a set of resources in the Operator's information and communication system, marked with an individual name (login) and password, in which the Referrer's data are collected, including information about orders placed on the Site, for which the Referrer will be entitled to a discount code.
3. CONSUMER - a natural person who makes a legal transaction with an entrepreneur that is not directly related to his/her business or professional activity.
4. OPERATOR - Dawid Ireneusz Martenczuk conducting business under the name H0PE.CLOUD DAWID MARTENCZUK entered in the Central Register and Information on Business Activity conducted by the Minister responsible for economy, NIP: 7393926062, REGON: 382989590, business address and address for delivery: 64 Żurawia Street, 11-036 Naglady, electronic mail address (e-mail): contact@redini.app, telephone number: +48 585 008 438.
5. RECOMMENDER - Partner using the Digital Service available through www.redini.app, who has entered into an Agreement with the Operator.
6. PRODUCT - a digital service offered by the Service, covered by the Referral Program.
7. RECOMMENDATION PROGRAM - a program to promote the www.redini.app .Internet Service among Internet Users
8. REGULATIONS - these regulations of the Referral Program.
9. SERVICE - the Operator's website operating at www.redini.app.
10. PARTIES - Operator and Referrer.
11. AGREEMENT - an agreement between the Operator and the Referrer to join the Referral Program under the terms of the Regulations.
12. USER - a person or entity interested in the Digital Service available on the Website.
§ 3
PURPOSE OF THE COMMAND PROGRAM
1. The purpose of the Referral Program is to promote the Operator's Website.
2. The Operator strives to popularize the Service among new Users, which becomes possible thanks to the participants of the Referral Program sharing the Codes, e.g. in their social media.
§ 4
RULES OF THE REFERRAL PROGRAM
1. The Referral Program consists in recommending the offer of the Service to other Users by Referrers, in order to expand the circle of Partners who will use the Product offered by the Operator.
2. Participation in the Referral Program is voluntary and free of charge, and does not affect the ability to use the Product www.redini.app. Any Referrer may cancel participation in the Program at any time by submitting a statement to the Operator via email, to the email address contact@redini.app.
3. Participation in the Referral Program gives the Referrer the opportunity to obtain a discount code, which entitles the Referrer to receive free access to the Product for one Billing Period.
4. The discount code is charged in accordance with § 7 of the Regulations.
§ 5
1. The information posted on the website www.redini.app about the possibility and method of joining the ReferralProgram addressed to potential Referrers constitutes only an invitation to make offers to conclude the Agreement.
2. In order to conclude the Agreement, each Partner interested in participating in the Referral Program should do the following:
2.1. familiarize yourself with basic information about the Referral Program available at www.redini.app,
2.2. register an Account with the Service and the Referral Program, using the form available on the website www.redini.app,
2.3. familiarize themselves with these Terms of Service, the rules and regulations of the Service and make their acceptance.
3. Referral status is obtained upon activation of the Referral Account by the Operator. Information about the activation of the Account will be sent to the e-mail address provided at registration.
4. The Operator shall have the right to cancel the Referrer's status in case the Referrer or persons acting on his/her behalf violate the provisions of these Terms of Service, the Terms of Service or generally applicable laws.
5. Each Referrer, agrees to receive messages from the Operator at the e-mail address provided in the registration form, on topics related to the Referral Program.
§ 6
REFERRAL SERVICE
1. The Referrer's task is to increase the Operator's revenue by inviting Users to purchase the Product available on the Website
2. Each Referrer has a unique Code, by means of which the Operator uniquely identifies the Referrer and the transactions carried out thanks to the Referrer's instructions, in the computer system.
3. Assignment of the User and his/her transactions to a given Referrer is made as a result of the User entering www.redini.pl and placing an Order therein using the unique Code of a given Referrer.
4. The Operator reserves the right to terminate the Agreement with immediate effect in the following cases:
4.1. Placing the Code next to infringing content, in particular:
4.1.1. pornographic and erotic content,
4.1.2. offensive, defamatory content, violating the personal rights of others,
4.1.3. content advocating the spread of hatred, racism, xenophobia, conflict between nations or religions,
4.1.4. content that violates copyright or other intellectual property rights, or encourages copyright infringement, including by providing information or materials that may serve to violate copyright or other intellectual property rights.
4.2. Use of the Code for unlawful purposes, and in particular to:
4.2.1. providing content of a harmful nature such as viruses, "Trojan horses", data containing "bugs" or other harmful or destructive elements or hyperlinks to them,
4.2.2. posting content or taking other actions that violate the principles of fair competition,
4.3. modification of the Operator-generated Code changing its functionality,
4.4. to distribute mass information about the Code to Internet Users (so-called spamming), using any medium (e-mail, mailing lists, newsgroups, instant messaging, IRC, etc.) or independently and not agreed with the Operator to place the Code on a site of a "chain of happiness" nature or any other site used for mass transmission.
§ 7
REFERRAL BENEFITS OF THE PROGRAM
1. When the User, using the Code of a specific Referrer when placing an Order, makes a purchase of a Product and pays the first Billing Period after a month of free access to the Product, the Referrer receives a discount code entitling the User to receive a free Billing Period of access to the Product
2. The discount code from a given Order is granted to the Referrer only in case of successful payment of the first paid Billing Period by the User. Subsequent months of paid Billing Periods of access to the Product by the same User shall not result in the granting of a discount code to the Referrer.
3. The Referrer's discount code may be reduced or reset by the Operator in case of identification of violation of the Terms and Conditions, the terms and conditions of the www.redini.app website or suspicion of unfair practices in recommending the Product to Users
4. The discount code entitling to a free Settlement Period will be sent to the Referrer by e-mail, to the e-mail address assigned to the Referrer's Account on the Site.
5. The Referrer will be informed of each Order granting him the right to receive a discount code.
6. The discount code is active for 12 months after payment of the Order for which it was granted. After the expiration of 12 months from the payment of the Order for which the discount code was granted, the Referrer is not allowed to use it.
7. The active discount code shall be used when the Referrer purchases the next Billing Period of access to the Product on the www.redini.app website. The Referrer should enter it in the "discount code" field. The valid discount code will thus be used and the Referrer will receive access to the Product for the next Billing Period completely free of charge.
8. The discount code from an Order can be used within 12 months after the Referrer has paid one paid Billing Period.
9. The discount code entitles the user to use it for the same package or "lower" than the one chosen by the user who placed the order using the referral code.
10. A user who purchases Products from an offer individually addressed to him/her is excluded from the Affiliate Program, which means no discounts.
§ 8
FINAL PROVISIONS
1. The Operator shall have the right to unilaterally and immediately block participation or terminate cooperation with the Referrer in the Referral Program in case the Referrer violates the provisions of the Terms of Service or the Terms of Service
2. Termination of cooperation with the Referrer due to the Referrer's fault, results in the non-award of Benefits in the form of a discount code.
3. If a violation of the Terms and Conditions or an illegal act is discovered later than the use of the discount code by the Referrer, the Operator shall not claim payment for the Billing Period used by the Referrer under the discount code.
4. The Operator has the right to amend these Terms of Service in the manner provided for amendments to the Terms of Service.
